The provision of the Section 172, para 3 of CrPC.
This is about Police Diaries,
"(3) Neither the accused nor his agents shall be entitled to call for such diaries, nor shall he or they be entitled to see them merely because they are referred to by the Court...;"
Maharastra Police has been using this provision to record their diaries at will, stretch the preliminary enquiry period as long as convenient, and keep their enquiry secretive.
During the course of the preliminary enquiry the Maharashtra police chooses to go any which way. It can choose to stay with the theory of suicide; or it may choose to doubt, it could be a case of murder. It was happy with the sucide theory ; and was happy that it was able to save those it was interested to save. Maharashtra Police is not a pious heart organization.
